Procedures of Examination & Approval on Reports Concerning Environmental Impacts from Constructional Projects


I. Targeted projects Subject to Examination & Approval: Constructional Projects

The constructional projects refer to the projects of new buildings, reconstruction, expansion and removal of buildings, projects concerning technological renovations, projects on regional development and construction, etc. The constructional projects involving the implementation of environmental protection controls mainly includTe:

All the industrial construction projects:

Water conservancy projects, river & stream realignment projects, land reclamation (seas, rivers, lakes) projects, various marine and seacoast projects, various river watershed development projects;

Harbors, wharves, airports, railways, highways, bridges, pipeline transportation projects, warehousing of hazardous, radioactive or chemical articles, and various types of storage and warehousing projects;

Projects concerning catering industry, butchery industry, hotel industry, commercial businesses, various urban and township entertainment & service industry, any projects involving central air conditioning facilities;

Projects of hospitals, sanatoriums, schools, scientific research institutes and their affiliated laboratories;

Telecom projects, projects with electro-magnet radiation facilities, projects with radioactive facilities;

Culturing and breeding industries, agricultural development projects;

Urban sewage treatment plants, wastes (garbage) disposal grounds (plants), urban environment control projects, and municipal civil engineering projects of urban water supply, road building and landscaping;

Various development zones (including industrial zones), tourist resorts, real estate property development projects, sports facilities development & construction projects, overall planning and construction of new urban districts with specific project items;

Miscellaneous projects specified by the State Environment Protection General Bureau and Provincial Environment Protection Bureau to be of some impacts upon environments.


II. Contents for Examination and Approval: Whether or not to grant approval on the constructional operations for the projects applying for going through the examination and approval procedures


Conditions for Examination and Approval:

(I) Having filled in the registration form for environmental impacts or having authorized the evaluation organization which is qualified to carry out environmental impact appraisals to prepare the environmental impact reports (statements); the contents of these forms, reports or statements complying with the actual conditions of the projects and with the specified standards or norms with information fully supplied in details;
(II) The site selection for the project meeting the requirements specified in the urban construction planning and the environment program;
(III) The construction of the project complying with the related state and local laws, rules, regulations, and requirements on industrial policies;
(IV) The construction of the project not bringing in tangible impacts upon environments, nor causing negative impacts or disputes across administrative regions or districts, nor resulting ecological damages;
(V) The disposal of contaminants and pollutants complying with the related standards and specifications on disposals as well as with the control requirements on total quantity;
(VI) Having passed the appraisals for environmental impacts that confirm the feasibility of the constructional project.

III. Procedures for Examination and Approval:
(I) The organization or individual of the project owner makes an application and supplies related information materials; and the location for handling this procedure is at the reception office of the Municipal Environment Protection Bureau;
(II) The Constructional Project Management Section makes verification on the supplied information (field survey may be made, if necessary) to determine the type for evaluation on environmental impacts;
(III) The organization or individual of the project owner fills in the registration form for environmental impacts or authorizes a qualified evaluation organization to prepare the report (statement) on environmental impacts. (Those who are authorized to prepare the report should work out an evaluation outline for environment impacts as required and specified by the environment protection authorities, and the outline is to be submitted to the environment protection authorities for examination and approval):
(IV) Upon receiving the above-said reports or statements concerning the environmental impacts, the Project Management Section will carry out the field surveys. The reports or statements concerning such projects as involving rather complicated issues should be verified and reviewed by specialists;
(V) Based on the principles concerning the examination and approval for the reports of environmental impacts, the Project Management Section will work out the formal written reply;
(VI) The procedures for the issue of the LICENSE FOR CONSTRUCTIONAL OPERATION DISPOSALS (NOISES) shall be undergone simultaneously for the projects involving construction operations.

(II) For infrastructure projects
Application report

Report (or Statement) or registration form for environmental impacts

Xeroxed copy of the written approval by the Municipal Planning Committee

Xeroxed copies of license for planned project, license for planned land-use

General plan, descriptions on initial designing

(III) For tertiary industrial projects
Application report

Report (or Statement) or registration form for environmental impacts

Layout plan for selected site

Certificate of site utilization (rent contract or Xeroxed copy of real estate property ownership certificate) and certificate on performances and purposes

V. Time Limits for Examination & Approval :
The examination & approval procedures for the reports on environment impacts, statements, and registration forms shall be completed within 30, 10 and 7 days respectively counting from the date of acceptance of the reports, statements or registration forms (if some supplementary information is involved, the time limit starts counting from the date when these information materials are fully supplied).

VI. Basis for Examination & Approval:
(I) Article 13 of the LAW OF ENVIRONMENT PROTECTION OF THE PEOPLE'S REPUBLIC OF CHINA;
(II) Articles 7, 10 and 12 of the REGULATIONS ON ENVIRONMENT PROTECTION CONTROLS FOR CONSTRUCTIONAL PROJECTS issued by the State Council; Articles 3, 13, 14, 16, 18 and 23 of the REGULATIONS ON ENVIRONMENT PROTECTION CONTROLS FOR CONSTRUCTIONAL PROJECTS IN GUANGDONG PROVINCE;
(III) Article 27 of the ZHUHAI ENVIRONMENT PROTECTION REGULATIONS

VII. Charge Rates: The examination & approval authorities charge no payment.
VIII. Supervision and Administration Approaches:
(I) To deepen the opening process of governmental administrations, to increase the transparency of the examination and approval procedures for constructional projects and to accept the inspection and supervision of the general public;
(II) To strictly observe such rules and regulations issued by the related authorities, such as the "System of Individual Responsibilities", the "Regulations on Investigating into Responsibilities in Defective Work Performances", the "Systems on Examination and Approval Undertakings", the "Commitments to Time Limits for Case Completion", etc.

Remarks: Prior to the handling of the procedures for the issue of the LICENSE FOR CONSTRUCTIONAL OPERATION DISPOSALS (NOISES), the project owner should make a payment to the municipal environment monitoring office for extra discharge of wastes in constructional projects as specified by the local law.
