Examination & Approval on License for Discharging
Contaminants
I.Targets Subject to Examination & Approval:
Any corporations, institutions or individuals engaged
in industrial or commercial businesses that discharge
contaminants to the environments.
II.Contents for Examination and Approval: Whether
or not to grant approval on the issue of the License
for Discharging Contaminants.
III.Conditions for Examination and Approval:
(I)With availability of the approval on the report
for environment impacts of constructional project;
(II)With availability of various effective and valid
data and references for the concentration and total
quantity of the discharge contaminants;
(III)Having passed the check & acceptance for
the pollution prevention facilities of the newly
constructed project;
(IV)The discharge of the specified discharge of
various contaminants not exceeding the control indexes
of the total quantity of discharge.
(For those organizations that make excessive discharges
of contaminants of the total quantity of discharged
contaminants exceeding the control indexes, a TEMPORARY
LICENSE FOR DISCHARGING CONTAMINANTS IN GUANGDONG
PROVINCE has to be issued).
IV.Procedures for Examination and Approval:
(I)The Ecological Protection & Pollution Control
Section of the Municipal Environment Protection
Bureau makes verifications, based on the information
materials supplied by the applicant, on the APPLICATION
FORM FOR REGISTRATION AND ALTERATION OF CONTAMINANTS
DISCHARGE IN CHINA, and the APPLICATION FORM FOR
EXAMINATION & APPROVAL ON ISSUE OF LICENSE FOR
DISCHARGING CONTAMINANTS (field survey may be made,
if necessary);
(II)The Ecological Protection & Pollution Control
Section of the Municipal Environment Protection
Bureau makes determination, based on the implementation
program for total quantity controls as well as the
local requirements on environment protection for
the area where the project applying for the issue
of the license is located, on whether or not to
issue the license for the discharge of contaminants.
V.Information Materials Needed for Verification
Procedures:
(I)APPLICATION FORM FOR REGISTRATION AND ALTERATION
OF CONTAMINANTS DISCHARGE IN CHINA, and the APPLICATION
FORM FOR EXAMINATION & APPROVAL ON ISSUE OF
LICENSE FOR DISCHARGING CONTAMINANTS;
(II)With availability of the approval on the report
for environment impacts of constructional project;
(III)A report on the monitoring and testing of the
discharge contaminants in the current year and the
previous year (the data for monitoring and testing
must be acknowledged by the environment protection
authorities), the receipts for monthly payments
on water supplies in the current year, and the receipts
for purchased fuels as well as the fuel quality
inspection reports for each month in the current
year;
(IV)Documentation concerning the inspection and
acceptance of pollution prevention facilities.
VI.Time Limits for Examination & Approval
The examination & approval procedures shall
be completed within 20 working days counting from
the date of acceptance of the application reports,
(if some supplementary information is involved,
the time limit starts counting from the date when
these information materials are fully supplied).
VII.Basis for Examination & Approval:
(I)Article 10 of the DETAILED REGULATIONS ON IMPLEMENTATION
OF WATER POLLUTION PREVENTION LAW OF THE PEOPLE'S
REPUBLIC OF CHINA;
(II)Article 11 of the REGULATIONS ON WATER QUALITY
PROTECTION IN PEARL RIVER DELTA REGION OF GUANGDONG
PROVINCE;
(III)ADMINISTRATIVE APPROACH FOR ISSUE OF LICENSE
FOR DISCHARGING CONTAMINANTS IN GUANGDONG PROVINCE:
(IV)Article 9 and 10 of the ZHUHAI ENVIRONMENT PROTECTION
REGULATIONS.
VIII.Charge Rates: The examination & approval
authorities charge no payment.
IX.Supervision and Administration Approaches:
(I)To deepen the opening process of governmental
administrations, to increase the transparency of
the examination and approval procedures for constructional
projects and to accept the inspection and supervision
of the general public;
(II)To strictly observe such rules and regulations
issued by the related authorities, such as the "System
of Individual Responsibilities", the "Regulations
on Investigating into Responsibilities in Defective
Work Performances", the "Systems on Examination
and Approval Undertakings", the "Commitments
to Time Limits for Case Completion", etc.
